WHY THE ELECTORAL COLLEGE IS IMPORTANT TO OUR REPUBLIC

Am I an alarmist? I’ve been crying foul for many years; became involved with some pretty shady (politically speaking) characters back in the mid-1990’s, put a great business I had in jeopardy, all for the “cause” of liberty. That shady involvement led to a couple self-published books, the loss of my business –California Mufflers & Performance Exhaust Systems— and even landing me in jail for a couple weeks over a dispute with a police officer due to an alleged traffic violation (a story of jurisdiction for another time).

During that time the local Sheriff labeled me as a “constitutionalist,” a label I still wear proudly, as I fought for liberty, and exoneration (which I won, in part). I wasn’t new to the legal field at that time as I had several constitutional law college courses under my belt from the 1980’s, but this exposure to the liberal California courts reignited my desire for political activism. I decided the macro controversy, in my mind, was over the slowly but surely weakening of our republic. That conclusion is still relevant today and even more critical. I could care less, then and now, about Party-line politics. My concern, then and now, is about lost liberty and the destruction of our Republic.

WE HAVE MORE FREEDOMS TODAY THEN EVER BEFORE, BUT WITH A LOT LESS LIBERTY-
I acquired my political wings during the 1980’s while I served proudly in the Marine Corps. Besides studying to be the best Marine, I was also reading and studying and attending classes regarding American History and constitutional law; along came President Reagan, seven years of military service, a wife and family, and a whole new set of reasons to love living in America. I didn’t learn how things should be by listening to political talking heads and media types; I learned by reading history. In my travels, during and after the military, I always made it a point to visit old damp used book stores whenever I had the chance, even overseas. I went to library and school book sales, and since its inception, I’ve been perusing through Google Books reading all that applies to Americana. And today, at this hour, I sit among a pile of books, believing we are in the end times of what America was meant to be. It may not be tomorrow or next year, but the writing is clearly on the wall; American Exceptionalism is coming to a halt and our republic has lost its power to protect the several states as well as the individual.

Alarmist? Perhaps. America wasn’t listening in the 1980’s or the 1990’s, but I am hoping some are beginning to see today the pattern of deceit and treachery coming to us from the mounting enemies of freedom in this White House and the Congress. In fact, the list of socialist leaning supporters, and their respective places among those who have influential pulpits, is growing exponentially all around us. At the very top, President Obama has talked of change, and that change includes his desire to completely alter a document which holds certain truths and concepts that we the people have a reverence for but still do not understand.

President Obama has said, among other things, that he wants to change our Constitution from a negative law document to a positive law document. Do you know what this means? It means Uncle Sam is getting out of the business of ESTABLISHING justice, INSURING domestic tranquility, PROVIDING for the common defense, PROMOTING the GENERAL welfare, and SECURING THE BLESSINGS OF LIBERTY to ourselves and our posterity (see: Preamble, U.S. Constitution). Instead, Uncle Sam has been relegated to the museum to make room for Big Brother who is now on his way to creating in mass a people who need all things of subsistence provided through a nationalized singular source- a socialist system of redistributed wealth, intent on being the caretaker to and of a dependent world.

WHAT HAPPENED TO SECURING THE BLESSINGS OF LIBERTY?

While many of you still scoff at this evaluation, I see it as plain as a clear day in May. While there are many phases to the President’s plan, his soon to come next move will be to take a stab at our republic, and I want to put it on record that I for one take great umbrage to its destruction. We have all heard as late the word “republic” being thrown around by the pundits, but “republic” is far more than just a word; it is the lifeblood of the several states, as well as securing the sovereignty of the individual. Our republican form of government is founded upon the concept of Sovereignty, a concept by which all natural rights flow. Without it our Rule of Law (America’s culture) becomes the Rule of Man (Imperium Vilani).

What do we mean by “republic? In short: the right of the people to lead a private life-

As this video shows, liberty cannot be exercised by the majority if there is total (potential) government control, but nor can liberty be exercised with no government. Our republic symbolizes that “place” where we the people live and breathe; where we work and possess property- it is where we pursue life, pursue liberty, and pursue happiness. Our republic is the domain of liberty, of 300 million monarchies limited only by the desire of interaction; and this is where, and only where, government becomes relevant- to “insure domestic tranquility” (Preamble, U.S. Constitution).

Governments (that promote true equality) do not bequeath rights. Governments can only set the stage for such rights to be best exercised by its inhabitants: ESTABLISHING justice, INSURING domestic tranquility, PROVIDING for the common defense, PROMOTING the general welfare, and SECURING the blessings of liberty. These tools are not the tools of democracy, but the tools to metered freedom. And metered freedom cannot be secured into perpetuity if 51% can rule the other 49%; with any favoritism, the smart, the dastardly, the evil, will find their way to the top and fascism becomes the finally. Our founders knew of this, and they established a federal system of independent states, guaranteed republican in form, to be assisted by a limited federal system, held in check by specifically enumerated powers, and the Electoral College.

A REPUBLIC MEANS YOU HAVE A RIGHT TO TRIAL BY JURY-

If there is just one thing in our Constitution that ensures our continued republic, it isn’t Article 4: sec 4; that one thing IS the Electoral College clause, Article 2; sec 1. The statist needs the republic dead, and to do so requires removing the Electoral College from our institutional framework. You and I need to save it before we all become dependent institutional clients in a socialized democracy.

The Constitution is not a compilation of separate do’s and don’ts, but a finely tuned machine with a series of necessary interactive components creating a singular working system – like a fine watch. These parts must be read and applied in context, in view of the intent of the entire document, and read in light of the context of our Declaration of Independence. Only in this context can we the people live free. An integral part of that system is our Electoral College.

It is from our republic that your Sheriff draws his authority to stop the (democratic) lynch mob.

Why is it that now, after more than two centuries of quality service, the left wing of the Democrat Party is making noise about removing the Electoral College (EC)? Strategic voting? We have states with laws aimed at allowing/encouraging cross-over voting. We have states proudly wearing the “direct democracy” label –in direct violation of our Constitution, and we (just the Democrats, for now) have the confusion, and perversive distortion, of Super Delegates –currently blackmailing the frontrunners for special favors. And now we have “plants” going across party lines in the hopes of sabotage. Doesn’t anyone see the eventual connection with all of these shenanigans and the eventual ouster of our current electoral system? Super Delegates is a temporary band-aid the left is using to pervert our system in hopes of “proving” the Electoral College is flawed and outdated.

The very Party that insists it is for the little guy; the one that cries the loudest about voter fraud; that every vote must count; that we must stop voter disenfranchisement; that will again demand reforming –and blaming-- the Electoral College, is the same Party with Super Disenfranchisement, and is the same Party that invented open convention/primary/caucus voting; it is the same Party filled with elites who are certain “they” know what is best for you, nobler and wiser than the rest of us. They give lip service to being democratic, but deny California voters their ballot-box wishes. They push through health care when polls clearly show the majority don’t want government-ran health care. You can pick any number of items that prove modern Democrat-led statism is the enemy of individual rights, and our republic is in their way to effect “change.” The liberal speak of equality, but in practice, it is the tyranny of “them” at the peril of you and our republic.

Their Egalitarian idealistic leadership hopes for ignorance and complacency among its people, rallied by words that stir those fuzzy warm feelings deep within our bellies (“Every vote must count!") and frustrate any chance at intellectual intervention. They operate using emotion as a cloak of darkness to cover up their long range dreams of a Utopian society; Republicans continue to fall into the trap, and conservatism continues its decline.

Isn’t anyone concerned for our republic? Is there anyone left who understands our Electoral College system; a necessary tool, under our republican form of government, to ensure equality among the several states, a vital tool for our republican form of government?

Tocqueville forecasted, “ever-increasing democracy,” leading to “.. the track which starts from equality ... leads to anarchy … lead(s) inevitably to servitude.”

“A republic, madam, if you can keep it-” What this means is that it is the people’s government. Our rights do not depend on the Constitution- they depend on us, our attitude, our knowledge, our fortitude, and our Electoral College.

During the Constitutional Convention Benjamin Franklin noticed a painted carving on the back of a chair in Independence Hall; the painting was of the sun half obscured by the horizon. Throughout the Convention he had been wondering if that picture was of a rising or setting sun. Finally, with the details of our federal Constitution brought to a conclusion, Franklin once again looked at this picture and noted, “At length, I have the happiness that it is a rising and not a setting sun.”
Then, once outside, Franklin was approached by the wife of the Mayor of Philadelphia. “What have you given us,” she asked?

“A republic, if you can keep it,” he replied.

A REPUBLIC, IF YOU CAN KEEP IT

So what did he mean by “republic?” “If you can keep it” is pretty clear- meaning there is something fragile, requiring perseverance and maintenance for preservation. Can we preserve our republic if we don’t understand it? It was/is so significant the Framers required it be a part of our Constitution (Article 4: sec 4) and distinctly not adding the word “democracy” anywhere in this ultimate governing document. Thus, a simple logical view of our founding documents show us what we have: Our Constitution states within the body that it is the supreme law of the land, and within that supreme document it states each of the several states shall guarantee to its people a republican form of government. So what do we have? We have a constitutional republic. But why?

Democracies fail. History shows us democracies always eventually evolve into dictatorial regimes because Man is flawed; it is natural for man to seek power; to plunder. When Man is directly in charge, a single man, or even worse, a group of men (mob) will invariably act on instinctual impulse, and always eventually, in his own personal interest. One minor law at a time, instinct will chip away at liberty. Once precedence is set, that part of liberty becomes history. As part after part becomes history, another “power” must move in to take its place and soon all we have is an almighty government that is required by law to plunder unopposed. It becomes an all-consuming authority with a kind of life of its own, no longer capable of being controlled; pre-WWII Germany is an excellent example – The Roman Republic, which turned into the Roman Empire, eventually self destroying from the inside is another excellent example. But we are, different.

American Exceptionalism in part, includes some precepts that history cannot equal. For the first time in human history, inalienable rights were clearly noted in founding documents. Americanism came full circle during the Revolutionary War, and our founders “discovered” a way to ensure perpetuity of our great land; remove basic natural law rights from the power of the masses, limit centralized government by inserting the entirely new concept of federalism, and preserve a bubble of power outside of the influence of man-made institutions. This protective bubble is our republic, only penetratable by constitutional due process, either by hook or by crook: by hook, meaning by contract (when an individual/person enters into a public contract demanding certain performances; or by crook, meaning when another claims he has been harmed/injured. Without one of these two elements, our whole existence is lived within the republic (under God- Nature and Nature’s God) and not within the man-made realm of the democratic process (Constitution- under color of law).

OUR RIGHTS COME TO US THROUGH THE STATES UNDER REPUBLICANISM

Our republic is a shield of protection that surrounds us, individually, with an impenetrable bubble, created under our Maker, and ensured into perpetuity by the 9th and 10th Amendments. This is why statists have been ignoring and poo-pooing the very existence of our republic- it is where inalienable rights exist, under God the Sovereign, which bequeathed sovereignty unto his creation.

It’s commonsensical the created cannot create something superior to itself. And to put this into perspective, we have to answer some simple questions: Who/What came first? Who/What created what? And this is where it is imperative that we do not buy into the complete separation of church and state as the statist hopes to achieve- natural rights can only be inalienable if they come from a source greater than Man, for if Man gave them, Man can take them, meter them, and mold them to meet what the powers-that-be determine to be the needs of the day. This is why we must not lose our founder’s ideals of Judeo/Christian values, and their necessity within our republican system of government. If you’ve been wondering why statists (liberals) have a problem with Christianity, this is it- the Natural Law is an outgrowth of Christianity, and as long as we have the Natural Law we have inalienable rights. And, as long as we have inalienable rights, we cannot have a democracy, and must distinguish our republic.

With answers, the questions above bring us to a logical chain of command: 1) God, [who created] 2) Man, [who created] 2) state, [who created] 3) Federal Constitution, [who created] 4) national public servant. With God no longer on top, the entire chain of command is turned upside down (which should answer some of your concerns about why so much of our system seems to be backwards). We have God, then Man, then institutions (and remember- the created cannot be superior to the creator). Thus, we have the procedural process of sovereignty.

Democracy is majority rule (tyranny); in simple but realistic terms, when the majority in your neighborhood no longer approve of the color of your fence they can force you to change it. When the majority decides, as in Islam, that Man is superior to woman, then such becomes law. Then, with that precedent, the law books become filled with statutes making it virtually impossible for women to regain equal footing without violence. This is the future of democracy, as it has shown us in the past. It pits groups against groups; the loudest, richest, strongest, win and the individual looses.

TODAY, WE SUFFER FROM THE ABUSE OF POWER BECAUSE OF A WEAKENED REPUBLIC

To stop this flaw in the democratic process our founders inserted Article 4: sec 4 into our Constitution. And, to ensure its functionality, they included Article 2, sec 1, creating the Electoral College.

One of the reasons for the Senate was to acknowledge state sovereignty and to equalize the field between the big states and the little states. The several states, individually, are sovereign entities, and just like a small person has the right to be heard and felt equally when confronting a larger person, so to do the states.

Our founder’s cry was for liberty, not for democracy. Without the Electoral College we would have majority tyranny, open to reactionary (shortsighted) politics. This might work with relative efficiency at local and state levels, but at the federal level we would have the 8 to 10 most populace states bullying the rest of the country, and a national “mistake” may be a fatal one. The will of the people was meant to be tempered by the wisdom of our elected officials that make up the EC.

States, with their own individual sovereignty, have a right and a responsibility to speak with one voice- the EC allows for this singular, significant voice for Kentuckians and Washingtonians and Nevadans, and New Yorker’s, and Delaware. If that singular voice becomes watered down by a plurality of voices, the voice of those in smaller states will be squashed by California or Texas, and the idea of being a Floridian or Tennessean will disappear.

On a national level we have to look at the states equally; if not, state sovereignty is further damaged. Vermont is a sovereign entity and it should be allowed a voice equal to that of Texas, thus, the Senate has equal state representation, two per state no matter their population. But without the EC Texas would easily swallow the will of the people in Vermont. Densely populated states would dominate national politics and rural America would have to comply with the desires of Los Angeles and New York. The East and West Coasts would be dragging Kansas, kicking and screaming, through a dictatorial nightmare. This would federalize all Law and give PACS just one place to work their liberal havoc on every individual; is this Liberty? Yes, it is democracy, but it ain’t freedom.

The President is the President of the federal union, not the governor of all states. The EC allows for limited government and gives all the other parts of the Constitution a chance to work to deliver smooth, enumerated (limited) government.

Densely populated areas have problems and issues that are specialized and in contrast to rural and other less crowded areas. Yet, with a one-voter-one-vote national system that has no regard for localized and statewide cultural/economic/religious/social circumstances, one-voter-one-vote will essentially force laws designed for urban areas, upon the entire nation.

One of the primary issues statists use to undermine the EC is to say that the founders saw a need to minimize rural voters upon national issues because so many were ignorant of national issues; illiterate, and/or simply had no time to visit and study political issues. But this could not be further from the truth, not to mention, misleading. By 1800, America was the most literate country in the world with over 100 newspapers spread throughout the then 16 states. Further, that same argument could be made today in the opposite direction: inner city dwellers tend be poorer and less informed; less populated states statistically have residents at higher percentages who own more land.

“Every vote should count,” falls easy on the ears, and the left’s hope is that such a battle cry will go directly from the ears to the heart, bypassing our intellect. “Every vote should count” all too often ended in the past with someone strung to the closest tree, as it is the chant of democracy supporters (Rule of Man).

State sovereignty- Obama Admin is giving signs of participating in politically correct international programs such as the U.N.’s Convention on the rights of persons with disabilities; a nuclear test ban treaty; a convention on the elimination of all forms of discrimination against women; an outer-space weapons ban, and a new START treaty. Then there is the International Court that the world hopes we sign on to, subjecting American citizens to its jurisdiction, NO MATTER THE CITIZENS PROXIMITY. The Human Rights Council (which received a report from Mrs. Clinton over the Arizona immigration issue), has been allowed to slowly work its way into our collective hearts, thanks to an ignorant activist media. All of these issues are in defiance of constitutional values and weaken the importance of the individual state.

Remember, you are an American citizen because you are first a state citizen- to prove this out a little logic will verify: Sovereign status must follow its natural course- downward, for no entity can create something greater than itself. Thus we have Man, then the several states, then the enumerated, limited federal government. Clearly the real power lies with the people within and among their respective states, and again, Delaware has the right to an equal voice when countering the collective voice of New York.

The word “republic” has been abused and kicked around since before Plato; Republic of China is one example – The Greek Republics is a very loose use of the word. The word republic has been used loosely and generically simple to draw in contrast to monarchies and Direct Democracies, for instance, but almost never fully described specifically as it relates to America and our natural rights; but now you know the connection. Be not deceived by shallow talking points- The 17th Amendment was the beginning of dismantling our republic and it lies on shaky ground. If it falls, so do our individual inalienable rights.

Be not deceived, nor ignore this truth: the greatest fight ever fought is one that cannot ever be totally won. It is filled with self-serviance, yet self-destructive; it is gallant yet unflattering. This fight is hard for the masses to see clearly, yet it is one which the knowing will endure at the peril of their own demise; this description fits both sides of the struggle. The conservative leaders endure because of their insatiable need to fulfill a sense of honor and dignity – the liberal leaders endure because of hate and disdain, driven by the guilt of their own personal success while others toil without reward. Ayn Rand sums this concept up in her book, The Fountainhead:

“A man’s RIGHT to exist for his own sake.” This is the fight of the individual against the collective, and our republic is in the way of the collectivist. If they take our Electoral College, they take our republic.

Hawaiian Governor was correct to veto bill abandoning Electoral College:

FOR MORE than two centuries, the Electoral College has been serving American politics very well. But recently, due to close elections for the U.S. presidency, some members of the Democratic Party at both the local and national levels have been advocating a change in the way we elect our nation's chief executive.
You might have seen television commercials advocating a so-called popular vote initiative. Locally, our state Legislature passed Senate Bill 1956, a bill aimed at enabling the winner of the presidential election to be determined by national popular vote rather than the Electoral College.
After surviving 19-4 and 35-12 votes in the state Senate and House, Senate Bill 1956 moved upstairs where it was vetoed last week by Gov. Linda Lingle. The governor did the right thing in vetoing this misguided effort. Now, it's important that the Legislature listen to common sense and not the newest television ads trying to stir up the idea of overriding that veto.
Our Founding Fathers understood the importance of small states and the ugly potential of large, populous states overwhelming the national presidential elections. Hawaii, although small in numbers and isolated in the middle of the Pacific, has shown its importance in the national election process as recently as 2004 when Vice President Dick Cheney and former Vice President Al Gore traveled to Honolulu because the election was too close to call.
DO WE AS CITIZENS of Hawaii want to give up that kind of empowerment? Of course not.
The federal Electoral College is the name of the group of presidential electors who came about because of the presidential election of 1800; when the electors of the Democratic-Republican Party gave Thomas Jefferson and Aaron Burr an equal number of electoral votes. The tie-breaking decision was made in the House of Representatives resulting in the election of Thomas Jefferson. To prevent a tie from occurring again, the 12th Amendment to the U.S. Constitution was passed, requiring each elector to cast only one vote for the office of president and another for the office of vice president. The presidential electors are chosen every four years by the state's political parties in the summer before the national election.
There have been about 700 failed proposals in Congress to change the Electoral College, according to the Office of the Federal Register. The latest try started with legislation nicknamed Every Vote Counts, which was introduced by Rep. Gene Green of Texas in 2004, and once again in 2007. Leaders in both the local and national Democratic Party, still upset with the results of the controversial 2000 presidential election, have been rallying state legislatures to introduce measures to decide our presidential elections by popular vote. This method would effectively remove the Electoral College without having to amend the Constitution.
THE CURRENT ELECTORAL College strengthens the status of minority groups because the votes of small minorities within a state might make the difference between winning all of a state's electoral votes or none of them. It enhances the political stability of the nation by promoting a two-party system that protects that presidency from impassioned but transitory third-party movements, and forces the major parties to absorb the interests of small states and minorities; and it maintains the federal system of government and representation. Each state is allocated a number of electors equal to the number of its U.S. representatives, plus its two senators, so Hawaii has four electoral votes. All states have at least three electoral votes, no matter how small they are.
Finally, the Electoral College makes certain that Hawaii's real voice is heard. Whether Hawaii votes for the Democratic candidate or the Republican candidate, all its electoral votes go to the candidate who gains the most votes here in Hawaii. If the current legislation is overridden, all of Hawaii's votes would go to the national popular vote winner. You don't have to be a historian or a political genius to figure out what that means.
IT'S IMPORTANT that we stand behind the fair and thoughtful concepts of the Founding Fathers of this great nation. Don't let a few disgruntled members of the Democratic Party change something that will make Hawaii's votes irrelevant forever.
Let your legislators know that an override of Senate Bill 1956 isn't in your best interests, isn't in the state's best interests, and isn't in the best interests of anyone in Hawaii who votes in future presidential elections. END OF GOV HOGUE’S WRITING+++++++++++
